TERMS AND CONDITIONS OF USE OF THE VIRTUAL ASSISTANT

This document establishes the terms and conditions under which you may use the WhatsApp channel and/or Chat (hereinafter referred to as “the virtual assistance channels”) provided by [Grupo Habitat] (hereinafter referred to as “the Company”).

Please refrain from using the virtual assistance channels if you do not agree with the following terms and conditions:

The responses, information, and data provided by the Company through the virtual assistance channels are merely informative and illustrative. They do not constitute advice, nor do they commercially bind the Company, nor represent a commercial offer; therefore, they do not create any binding obligations between the parties.

The Company may request certain personal data to provide an adequate service during your interaction through the virtual assistance channels. Such data will be processed by the Company in order to provide the requested information and to contact you by phone, instant messaging, or other means of communication for the purpose of addressing your inquiries, verifying the quality of your experience, promoting, marketing, or offering the Company’s products and/or services, and, in general, for the purposes contemplated in our data processing policy, which you may consult on our website.

To access the virtual assistance channels, you must have an internet connection and a smart device capable of receiving or transmitting the information described herein.

You accept that the use of the virtual assistance channels may be affected by the impossibility, delay, or poor transmission of data or operations requested via your cellular system due to device failures or other issues, as well as technical problems or service interruptions, which are not attributable to the Company. However, the Company provides other channels where you may access the same services offered, which can be found on our website.

As a client and/or user, you accept that the Company has the authority to determine which services or operations will function through the virtual assistance channels, as well as the conditions applicable to their use.

The Company shall not be responsible for any failures that may occur during your interaction through the virtual assistance channels in the following cases:

•⁠ ⁠⁠For the incorrect, fraudulent, inaccurate, or improper use of the virtual assistance channels.
•⁠ ⁠⁠If the service is delayed, interfered with, or interrupted due to force majeure, acts of God, or third-party actions that prevent, delay, or alter the service.
•⁠ ⁠⁠For damages of any kind caused by impossibility, delay, or deficient transmission of data or operations requested via your mobile system, due to failures in your equipment, telephone networks, or other causes beyond the Company’s control, including maintenance activities or service suspensions.
•⁠ ⁠⁠For information provided through the virtual assistance channels, since it is purely illustrative and may contain errors or inaccuracies. By using these channels, you acknowledge and accept that the Company is not responsible for the content or for decisions made based on such information.
•⁠ ⁠⁠For any viruses that may infect user devices while using the channel.
•⁠ ⁠⁠In general, for failure to comply with the measures you must adopt as described in these terms and conditions.

To use our channel, please note:

You authorize the processing of your personal data and accept these terms and conditions when using the virtual assistance channels. This authorization is given by engaging in conversations through these services.

The Company may suspend your access to the virtual assistance channels in the following cases:
(i) When irregularities are detected in your use of the service;
(ii) As a security measure to protect your or the Company’s interests;
(iii) In case of non-compliance with the conditions established in this document.

Misuse – The use of these channels is prohibited for:
a. Carrying out or facilitating dangerous, illegal, or malicious activities.
b. Promoting or enabling illegal activities or violations of the law.
c. Misusing services or causing damage, interference, or disruption.
d. Promoting or facilitating the generation or distribution of spam.
e. Creating content for deceptive, fraudulent, or scam-related activities.
f. Attempting to bypass or disable security filters or making the system operate in violation of our policies.
g. Manipulating, generating, and/or distributing content with the intent to misinform, provide misleading information, or confuse.
h. Providing misleading information about the origin of generated content with the intent to deceive.
i. Impersonating another person (living or deceased).
j. Making misleading claims about knowledge or capabilities, particularly in sensitive areas such as finance, health, public services, or law.

Intellectual Property and Security – The software and/or various codes used for the operation of the virtual assistance channels are owned by Krino and/or its service providers, in accordance with current intellectual property laws. Any reproduction, alteration, modification, or commercial exploitation is expressly prohibited by law and may result in civil, commercial, and criminal penalties.
